Terms of service

Pure Soil reserves the right to change these Store Policies and Terms of Use at any time, effective immediately upon amending it. To check for changes to the Terms of Use kindly check this page periodically. Violation of these Terms of Use could prompt Pure Soil to terminate your use of their services, and/or take the appropriate and required legal steps to ensure continued compliance.

 

  1. OPERATION. United Arab Emirates is Pure Soil's country of domicile. Pure Soil is a registered company licensed under the name "PURE SOIL GOURMET TRADING L.L.C S.P.C" and is located in Abu Dhabi, U.A.E. Pure Soil makes no representation that its services/products are appropriate for use in other countries unless such claim was agreed with the client on separate terms and conditions. If you use our services/products from other locations you are responsible for ensuring compliance with your local laws. You may not use, export or re-export any materials in violation of any applicable laws or regulations, including, but not limited to any U.A.E export laws and regulations.

  3. APPLICABLE LAW. The Laws of the United Arab Emirates shall govern the use of the services/products and the Terms of Use, without regards to conflict of laws principals. All disputes arising in connection therewith shall be heard only by a court of competent jurisdiction in U.A.E.
  4. MULTI-CURRENCY PRICED TRANSACTION. The displayed price and currency is AED (Arab Emirates Dirham). This will be the same price and currency charged and printed on the transaction receipt.
  5. PAYMENTS OF PURCHASES. Pure Soil accepts payments for its products by (1) Credit/Debit Card through the website or payment link sent to the client's email and/or WhatsApp, by (2) bank transfer directly to the ADCB account of Pure Soil Gourmet Trading LLC SPC, or (3) as Cash On Delivery (COD being only for Abu Dhabi transactions). For payments using the Payment link option, Pure Soil accepts payments using Visa or Mastercard debit and credit cards in AED. All online purchases are also governed by the terms and conditions of respective merchant service providers. 
  6. REFUND POLICY. For the safety of our clients with fresh food products, all purchases are considered a FINAL SALE and no refunds can be processed after the order is delivered unless proof is shared of any spoiled items received upon receipt of such items and on the same day of delivery of such items. Such claims will be investigated alongside our client prior to processing an exchange or refund and to ensure no such instances occur in the future.
  7. CANCELLATION POLICY. An order can be canceled within 24 hours of ordering but not later than 24 hours prior to the day of delivery for general items available in stock. Any items that have been freshly prepared upon the client's specific order, or custom made with customizations for the client, cannot be canceled after receiving the order confirmation. In all cases, no cancelations can be accepted after the payment is made.
  8. SUBSCRIPTION POLICY. A subscription provides the client a consistent supply of the product subscribed to with weekly deliveries of a maximum of 4 deliveries, unless more deliveries are stated in the said subscription. All reference to a month in this Subscription Policy is of 28 days / 4 weeks, and not a calendar month. All subscriptions require an upfront booking for the month with payments made 5 days prior to the beginning of the subscription period. Subscriptions cannot be canceled during the booked month. Subscriptions will auto-renew for the next month (of 4 weeks) with a reminder sent 2 days prior to the renewal date. Subscribers can cancel their subscription for the next month at any time up to 2 days after the last delivery of the current month, which is 5 days before the first delivery of the next month. Subscriptions can be paused for a maximum of one week during any booked month, which would add an extra week to the client's subscription period. You can upgrade your subscription at any time and the price of the upgrade will be on a pro rata basis. In the case the subscribed to product is not available during the booked delivery day, Pure Soil will inform the client immediately and pause the payment of that week until the product is available during the same week or otherwise paused till the next week. The client has the right to count any weeks paused by Pure Soil as part of the subscription period and not in addition to it for cancelation purposes. Failure by the client to receive a delivered product will result in an additional delivery charge if the delivery is to be attempted again, and an additional payment with the full price of the product if Pure Soil had to send a new fresh product replacing a product spoiled as a result. Pure Soil can cancel a client's subscription  prior to the first delivery of the next month's subscription if the product may no longer be available to fulfill the full subscription period or if the area of the client can no longer be serviced by the delivery company. Pure Soil can cancel a client's subscription at any time if there have been any consistent delivery problems with the client or if there have been any issues with regards to payment processing with the client.
  9. PRIVACY POLICY. All the information the client provides to us either in written or verbal form will be treated confidentially and can only be used by Pure Soil. Communication of promotions or new products will be made using the details provided to Pure Soil, unless the client specifically requests that no more communication is issued directly to them. Information provided to Pure Soil can only be shared with the local government, authorities, or court or when required by law.
  10. OFFICE FOREIGN ASSETS CONTROL (OFAC) SANCTIONED COUNTRIES. Pure Soil will not trade with or provide any services/products to individuals and companies owned or controlled by, or acting for or on behalf of, OFAC targeted countries and individuals, groups, and entities, such as terrorists and narcotics traffickers designated under the OFAC programs that are not country specific.
  11. REPRESENTATIONS BY YOU. By using the payment link on this website or that sent directly to you for payment, you represent, warrant and covenant that (a) you are at least 18 years old; (b) that all materials of any kind submitted by you to Pure Soil through payment link will not plagiarize, violate or infringe upon the rights of any third-party including trade secret, copyright, trademark, trade dress, privacy, patent, or other personal or proprietary rights. The customer using the payment link who are Minor /under the age of 18 shall not register as a user of the payment link and shall not transact on or use the payment link. 

    Cardholder must retain a copy of transaction records and https://www.puresoil.ae/ policies and rules. Used is responsible for maintaining the confidentiality of his/her account. 

  12. DISCLAIMER OF WARRANTY, LIMITATION OF DAMAGES. PURE SOIL MAKES NO WARRANTY OR REPRESENTATION OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTY OF TITLE OR NON-INFRINGEMENT OR IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR OTHER VIOLATION OF RIGHTS IN RELATION TO THE AVAILABILITY, ACCURACY, VALIDITY, RELIABILITY OR CONTENT OF THESE PAGES AND/OR THE SITE. PURE SOIL ALSO DOES NOT MAKE ANY REPRESENTATION OR WARRANTY REGARDING THE ACCURACY OR RELIABILITY OF ANY ADVICE, OPINION, STATEMENT OR OTHER INFORMATION THAT IS SUBMITTED, DISPLAYED OR UPLOADED THROUGH THE SITE BY ANY USER. PURE SOIL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, LOST PROFITS OR FOR BUSINESS INTERRUPTION ARISING OUT OF THE USE OF OR INABILITY TO USE THIS SITE, EVEN IF PURE SOIL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF CERTAIN WARRANTIES OR LIMITATIONS OF LIABILITY, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THE LIABILITY OF PURE SOIL WOULD IN SUCH CASE BE LIMITED TO THE GREATEST EXTENT OF LIABILITY PERMITTED BY LAW.

 

11. VIOLATION OF TERMS OF USE. You understand and agree that in Pure Soil's sole discretion, and without prior notice, Pure Soil may terminate your access to the payment link, or exercise any other remedy available and remove any unauthorized user information, if Pure Soil believes that the information you provide has violated or is inconsistent with these Terms of Use, or violates the rights of Pure Soil, or any third party, or violates the law. You agree that monetary damages may not provide a sufficient remedy to Pure Soil for violations of these Terms of Use and you consent to injunctive or other equitable relief for such violations. Pure Soil may release user information about you if required by law or subpoena.
